Society noc for gift deed

Hello,

My mother wants to gift property in a society.The society has acquired land on 999 years lease and then allotted to memebers. Our lawyer has asked for NOC of society since it is a lease deed from society. The society chairman is not willing to give a NOC.

What can we do?

You may sent a written request letter to the chairman/secretary of the society vide Registred Post or Spped Post with Acknowledgment Cue card.

 

Let the society gives it reply in writing and gives reason for not giving NOC for the Gift Deed.

1.  A Lease-Hold property CANNOT be Gifted, more so since the lease holder is not the "title-owner" of the property

.

2.  However, in a Society, membership can be transferred AFTER obtaining the NOC of Society.
