you can file a petition in High Court  to quash FIR and reinstate service. this is authorized by supreme court

It may not possible to suggest without knowing the details of the case i e whether the complaint is on official duties or on private  complaint.

its a private complaint about sale of a land. Actually a remake of a civil problem into a criminal case.

There is no connection b/w the case and official duties. Suspension is only becaz of 48 hrs under police custody.

Even during the pendency of the de[artmental enquiry the order of suspension can be set aside by the High Court if it can be found that the order of suspension was wholly arbitrary and disproportionate to the charges.

But he got arrested and CC filed against him. we filed a quash peition in HC.

But how to revoke the job.

Either get an order from court and submit it to the department or request the department to revocate. Pl remember that department may also initiate departmental proceedings parallel to the court or even after acquittal from the court.

Is a central govt. employee is eligible to get transfer benifit on the revocation of suspension and posted at the place other than the place where he was suspended?

 

please clarifiy the rule position.

Yes.Eligible for the transfer travelling allowances and the lumpsum grant as there is a change in place of posting.

The query is how to revoke suspension.

 

Appeal to the department. Suspension is appealable though not a punishment.

 

If not accepted then to the appropriate court. Central/State Administrative Tribunal.

if  a central govt. employee is eligible to get transfer benifit on the revocation of suspension and posted at the place other than the place where he was suspended,

 

then from which CCS(CCA) rule, he will be able to get transfer benifits. 

 

please clarify it.

CCA Rules do not deal with transfer grant. Please consult TA Rules.
