Iam from Chennai. I own a property at Thirumsazsai , Poonamalee , Chennai which has been rented out to M/s Nutrisea Food Products , who are into exports of chilled sea food. The said company is in my premesis since last 7 years.
They have wilfully defaulted on rent for past many years and total arrears as on date is nearly Rs 50.00 lacs after deduction of Rental advance.
They refuse to vacate and also not paying the rent. Now since the new LA act of Tamilnadu has been in force , the courts refuse to accept RCOP case for eviction citing that new act is in force and court cannot accept. The Rent control courts to be formed by Collector and they are unaware of the new act.
What is advice by this forum to file RCOP case for eviction on Wilful Default. who is to be approached.
