Regarding issuing no objection certificate by employer

Respected all,

 

Suppose person A is working in a State Govt. University in India and he has completed his probation period successfully. He is having approx. 4 years 10 months of experience in the same university. Suppose person A has applied for outside job ( here outside job means job outside from that university i.e. in other university) in 2013  and his application has been forwarded through proper channel. Now person A has again requested to forward another application for the same post (here same post means the post on which the person A working currently during the period) in other university, but the university authorities has forbidden this time to forward the application by giving the reason that in a year ( here year means calender year) only one application can be forwarded as per university rules in which person A is working. So person A has waited for the next year i.e. for 2014 and in 2014 he has requested again for getting NOC for the post he has applied second time (as the interview has not been conducted till now)  and he requested that in 2014 he has not requested the university authorities to forwarded any application for any post in 2014, so he should be issued No Objection Certificate against calender year 2014.   

Now, the questions are :

1. Whether person A is entitled for NOC in 2014 as the previous application was forwarded in 2013 as per              university rules?

2. Whether the university authorities can forbid to issue NOC mare by giving the reason that in a year only one      application for the same post can be forwarded in a calender year ?

3. Whether person A can approach in any court of Law for this?

You have not stated what kind of privilege is there in forwarding the application or issuing no objection.Neverthless,he is seeking fresh employment based on his qualification and experience.An experience certificate will meet his requirement.
