Property will

Dear Sir ,

Pl. reply the answer of  my questions :-

My father brought a house 1983 and will  deed this house in the name of my mother 2001 and my father expired in 2004 , we are 2 brothers . my brother has been also expired 2012 . My mother will this house in the my name in 2014 and she is alive . My brother wife and his minore son can be claim any right in such property that was will by my mother in the name of me

Was the WILL executed after death of your father to transfer the house in name of your mother?

Did you and your brother sign NOC during transfer? Or Was the WILL probated?

Was it registered?

Was the house duly transferred in the name of your mother on the basis of WILL?

 

Is the WILL of your mother, favroing you, registered?

 

Are witnesses in the WILL unshakable?

The will was executed before my father expired .

The will deed was registered and withness by My self and my wife .

My brother was out of india, hence he was not withness of this.

The house was transferred in the name of my mother.

Why you are asking NOC was required from my brother ?

You have posted following replies to the points raised.

 

---"Was the WILL executed after death of your father to transfer the house in name of your mother?"

 

'The will was executed before my father expired .'

 

The WILL must have been produced to the authority under whose jurisdiction the property falls, after death of your father.

 

"Why you are asking NOC was required from my brother ?"

 

Uusually the standarad  procedure is to obtain NOC from other successors/legal heirs if the WILL is not probated. Or it is asked to probate the WILL
