Promissory note signed in different state

Hi,

I have given a loan to a person in my native village in A.P by having a promissory note as the guarantee. The person is refusing to pay back now. I am in working in Bangalore and can I file a complaint here in Bangalore for a loan given in A.P. The promissory note is in Telugu language.

Since the cause of action arose in AP, you have to file the case in appropriate Court in AP.

 cause of action arises at any of the following places:

  1. Place of contract

  2. Place where contract was to be performed or performance completed thereof

  3. Place where money was expressly or impliedly payable.

As the author of the query says that it was just a loan the cause of action is in AP only.

Jurisdìction to file suit for ŕecovery òf loañ amount lies where the loan amount was given/ promissoŕý note was executed I.e A. P.
