I was walking back home with a friend at 12:30 in the night and the a police jeep approached us and started abusing us ( they were drunk) . I questioned the abuse and they took us to the police station . I told them I will approach court and after some time they released us . Few days later they charged a petty case IPC 290.
I did not pay the petty and challenged this in court. My friend was also charged with the same case .
There is no witness to this episode and police do not have any independent witnesses. Can the Judge still impose a fine.
How can we defend this case? Also can anyone please help me with some relevant case laws?
