Pagri to ownership

Dear Member, 

Need your guidance.

we have been staying in a 3 storey bldg in kurla (w), Mumbai in a pagri system currently . The owner of this bldg to whom we were paying rent passed away and his two sons which unfortunately are enemies of each other. 1 brother sold his share to one builder & 2nd brother shares are still in dispute with this builder. however we have stopped paying rent as we were not sure whom to pay the rent out of the two brothers. but we are collectively as tenants are paying the water bill with the BMC regularly. 

As of today the builder is now claiming that he is the landlord of the building and wants to redevelop this bldg which we all as tenants are ready provided the terms are agreed to tenants n builder/landlord. we have had several meeting regarding the re development however not so productive. 

The issue here is, the builder says that the new bldg after the redevelopment will be on ownership basis for which he is claiming 15% of the current value of the flat from us which we think is quite high....

My question.

1.Do we have to pay anything for ownership after redevelopment to the builder. IF Yes then on what basis. Cant we claim for ownership for free of cost in this new bldg. as he is not providing us any extra area in the new flats.

2. Wt is the FSI provided in our AREA kurla (w) Hall Road pin code 400070. our bldg is over consumed since last so many years.
