Ncdrc

Respected Lawersclub Members,

We had filed a Consumer Complaint against a Builder in 2007 and an order was passed in our favour in 2009. The Builder appealed against this order in NCDRC whereupon an order was passed on 23/05/2014. A copy of the said order is enclosed. Our queries are now as under:

  1. Can the Builder seek a review of this order by NCDRC?
  2. Can the Builder appeal to Supreme Court against this order?
  3. If so, by when does the Builder have to file such appeal in the Supreme Court?
  4. What is the meaning of 'SLP' ?

Meanwhile, I wish to thank the respected members of Lawyersclub for the valuable guidance given to us from time.

Regards

Partha Roy

Hon'ble Members:

An Execution order was filed in respect of the above order and the following direction was issued:

"Issue notice upon the Judgment Debtors by Speed Post with A/D fixing 30.10.2014 for Service Return"

My questions are now as under:

1. What happens after issuance of above directions? Does O.P have to appear in court on 30/10/2014?

2. How long does it generally take for such orders to be executed, after issuance of Notice?

3. In original order of NCDRC, O.P was given 30 days time to execute the order but they failed to do so. Does this constitute an offense and can the O.P be punished by the State Commission for acting in contempt of NCDRC orders/ provisions of the Consumer Protection Act?

Regards

Partha Roy
