Motor vehical act

Dear Sir,

 

As X sold there car to Y and Y sold to Z  but the registraion still in the name of X and the Insurance also in the name of X . Y given Delivery Not To X and Z given To Y but both not transfer the Car in his name . Now while Z driving the car he made one aacident and one old man 75 yrs Expired after 5-7 days in Hospital .Z with police help taken the Person to Hospital for tretment  Y  given statement to MV act cell  under the MV Act 133 that saying  above story . The car is still under Police custody . The Fir Lodge under 297 and 304A . Z is realeas by the police on Bail. Now what is the procedure for realease the car . And who will be punishable under this circumstances.

For restoration of your vehicle file an application under 451 of the Criminal Procedure Code before the Magistrate First Class. Regarding liability check the RTO office in whose name the vehicle is registered, and the name registered in RTO will be held responsible for the liability  that is X or Y or Z. depending on the nature of accident to be fastened the liability on the Insurance or the owner.
