I want to raise query on claiming damages from the Opposite Party in case of Motor Accident ,where the insurance company is not covering all costs.
A known associate had an accident while on his way to Pune from Mumbai with his family,nobody was hurt.But the driver of the travel company overtook the car from the left side and caused severe damage to my associate's car.The claim was made from my associate's insurance company only as in India claiming third party would take a long time.The passenger travel bus suffered no damage.But the insurance company is not paying or covering the full repair cost.Estimated repair cost is very high, .
My associate wants to claim from the Owner of Travel bus company for out of the pocket expense .Please advice.
