Irregularities in receiving rent from tenant

Hi,

My parents have rented a commercial place to known person few years. He rented the shop under the context signing agreement. But the tenant later denied signing any agreements and was paying rent through cheques sent in courier (without getting rent receipts). As years passes he started using the situation not increasing the rent and now started showing irregularities in rent payment like he defaults paying rent for a month and in next month courier he just sends 2 cheques combined but smartly putting cheque date as previous month. Should we straight away file a default case. But not sure how to prove the irregularities since he puts the date in cheque correctly while sending it according to his wish\convince. Please advice

If you don't want to continue with him you got to evict him from the premises.send him a notice asking him to vacate the premises giving him a months time

These things are common on with those living away from rented places.  There is no guarantee that the new tenant co-operates, whereas you are aware of the old devils tactics and atleast some relationship/friendship exists.  It is always better to have some relations at that place to show effective controls in collection of rent.  Almost every one that rented the properties are facing same situation.  To get a good tenant is also fortune.  It is you that has to take a deision, as the known devil will not vacate as he knew your weakness.  These devils even file civil cases with forged documents , get expartee decrees, mutate the properties in their names, and we will be coming to know after several years after demise of parents.  At present not a legal matter and still in decision stage.
