Indian resident status to apply for dealership

Dear Legal Experts,

    A person has been working outside of India for the last 3 years and visits to India every year on vacation. So, he will be treated as NRI with respect to Income Tax Act laws. He wants to apply for some governmental dealership and it says that 'Only Indian Resident Should Apply'. The Income Act says that an individual will be treated as a Resident in India if he/she is in India for atleast 182 days in that year. I am thinking that the Resident of India and NRI status are for Income Tax filing purpose only. Can this person apply for the dealership or not? Please provide your expertise in this regard. Thanks in advance for your opinion.

this person is not apply for dealership beacuse person is not indian resident as per income tax law.

As per goverment dealership policy, only indian resident is eligible this dealership and income tax return is main evidence for resident status. one option open this peraon, as per income tax act, second option ( person who is stay p.y 60 days more in india and 360 days more stayed in preceeding four year immedaitely p.y) is called resident.
