Hi All,
Today i got one decision of Patna HC related to a AB application. In a strange manner, i have found some points in the decision which is false and do not have any evidence in support of that. Now my question is:
1. Can HC mention something in decision for which there is no evidence? Like in high court decision, the court mentioned that there are 3 directors in the company but fact wise there are only 2 directors
2. In the decision, the HC mentioned that on demant of Drector 1, director 2 has given him 50 lakh but there is not demand letter or anything like this.
So, what can be done for this? should i move to the HC for revising of decision or move to Higher court with highlighting the fact that the decision is a influenced decision?
