S.JEEVAGAN, Madurai. (Advocate, High court )     18 September 2015

Divorce - subsequent conduct of wife- can be noted

Hindu Marriage Act (1955), S.13(1)(ib) - divorce petition - Subsequent conduct of wife - Can be noted to show pattern of behaviour and conduct on basis of non-disputed material brought on record - divorce petition on ground of desertion - Subsequent events of mental cruelty - Apex court can in its power under Art.142 take notice of and decide case itself without asking respondent husband to amend petition and direct family court to consider issue of mental cruelty - It would be logical to do so and illogical to refrain from doing so.
