Divorce petition under section 13(1) (ib) HMA

Dear experts,

I filed an RCR u/s 9 HMA against my wife.

The suit is pending for more than two years now.

Under such circumstances, is it appropriate to file the divorce petition u/s 13 (1) (ib) of HMA since the two years of continuous period of desertion has completed?

Kindly explain.

First let the RCR petition come in your favor. Ask judge to finish the case ASAP. Once you win RCR, easy to get divorce under 13, 1. Then no need to pay alimony too stating that she did not come, so you wont give money. You can get divorce easily if you win section 9 case.
