Sir,

 

Procedure is very simple, make a settlement deed, file first motion then second motion and if any Criminal case is pending go for the Quashing of the same.

first work out a mou between you two regarding things like child custody, alimony, sreedhan etc etc and attach it along with the mutual divorce petition that you both need to present jointly before the family court.there will be a 6 months cooling off period and after that you need to file the first motion petition before the court.the court will record the statements and you both need to file the second motion after 6 months and within a year of the time of first motion.after this you both will be granted mcd

Thanks for the responses. We are based out of Pune and got married in Mumbai. Where do we fike the request? And do we need lawyer assistance for preparation and filing of MOU? Can we get a format for the same?
