my case is in caw cell. i want to go for divorce ,my wife ,bil ,fil are all touturing me to transfer all my salary to her account every month and ask for share in my fathers property or else they will sue me in false dowry .dv case  .i have filed the complaints for there intimidation  ,which is transfered to caw cell.

i m presently staying in a rented house with my wife.my wife is also working.

what stand should i maintain in caw cell -- should i straitforward ask for divorce --wont it create more liabilities on me  or any other way out .our marriage was dowryless and i have all the proofs.

Dear DNS,

 

Presently you are staying with your wife. Unless both husband and wife don't live seperately, the divorce is not permissible as it amounts to collusion between the parties. If your wife or you leave either of your company and start living separately in such circumstance, divorce petition can be preferred. The liability that will be of paying maintenance to your wife.

Take a stand that you are ready to settle the matters amicably.

 

Also divorce is granted by the court, on fault grounds the consent of the other party is not necessary.
