Can legal action against vendor for cheating should be initieted in criminal and civil simulteneously

I have contracted A Elevator vendor for errection of lift in my private building but even after 85% payment the vendor have not completed 50% of work. So, I filed complaint against vendor in police station for cheating and the complaint is pending in police station since last 4 months. Now, I want to initiate legal action against vendor in civil courts. My query is can I proceed with civil action pending criminal complaint. Thanks in advance. Arvind Deshmukh
