Under the partition suit, Civil court have been decreed shares. Later on, vendees filed regular first appeal in the honorable high court. This RFA also decreed as per civil court decision. FDP filed in the civil court as per the cause list in civil court and high court. Now, honorable judge is asking to exclude vendees in the cause list, and cause list should include only the share holders in the suit scheduled property.
Our Advocates contention - the cause list should not be altered until the disposal of the FDP. If the cause list is altered then, difficulty arises to file execution petition.
