Buying a land from a person who has mentally retarded sons

Hello Sir, I want to buy a land from a person, my worry is the seller has a mentally retarded son. Is it legal to buy such property? Please advise.

If the property is ancestral and if son is major then father can sell as gaurdian beczson is mentally retarded.if it is self acquired of father ,father has rightto sell.

The age rarely counts in case of mentally retarded legal heirs. If the purpose is stated as necessity for supporting the family, there may not be any problems.  Let the sale deed be drafted by a professional advocate with witnesses from mother or nearest guardians.
