When a Indian seafarer dies onboard a ship by an accident within the Juristriction of Dubai , is the next of kin entitled for both settlements given by Protection & Indeminity (P&I) club as per Collective Bargain Agreement (CBA) and the blood money as per the verdict of the federal court in Dubai?
Our understanding is , P&I claims settlement will be as CBA , under civil liability & federal court verdict comes under criminal liability on ship owners or document of compliance(DOC) opearators.Please clarify & advise.
