I have been on this forum before about this subject of Axis Bank not giving info and has been not transmitting DMAT a/c and FD funds to the registered nominee. (me)
It has been 8 months of constatnt struggle to get account info about my deceased parents and to get the funds transferred to me who is not only mother's nominee but also ultimate beneficiary per father's last will. Both parents are deceased. Mother had life interest in father's estate and I am the residual legatee.
Axis bank (Fort Mumbai and Kolkata ) has been withholding info about these accounts and how these accounts can be transferred to me. Wrote multiple E mails to local branch officials ,nodal officer, principal nodal officer and eventually CEO. No clear reply. Eventually, as suggested by lawyers on this forum, I hired an attorney and sent legal notices with copy of will, FD certificates showing me as registered nominee and nomination for the DMAT account. No reply to legal notices.
Sent portions of RBI regulations, 45 A to Z, companies act 109A, RBI master rules 2013 ..still no clear answer. Bank keeps wasting time and just sitting on DMAT, FDs and savings account funds which I have inherited. I even sent them the balance sheets of the Estate.
Axis Bank has given me the worst banking experience of my life. I am a US citizen with Overseas citizenship of India. The bank is not following the RBI rules and is obviously breaking the Banking regualtion act and other laws by unlawfully controlling nominee/beneficiary's funds.
My Question is what I need to do next....file a consumer court lawsuit ? Approach RBI senior officials ? Write to Ministry of Finance/foreign affairs ?
Is this common in India to harass nominees of the deceased ? Is it corrupt practice by Bank or is it normally accepted practice to keep niminee in limbo for months or years? Please advice how to deal withb this horrible bank.. There has to be a way. Please tell me how to proceed further. (I do have a lawyer in Kolkata and Delhi ).
