Apartment owners association membership

Dear Sir.

We are about to form an apartment owners association under Karanataka Societies Registration Act 1960. Some owners are residing outside India. If we form the owner's association without some of the owners, the questions are:

1. Will the owners residing outside India automatically become members  of the association? They are not physically present at the time of registration of association.

2. If not, can their names be included in-absentia with written consent?

3. If they can neither become membes automatically nor in-absentia with written consent, are they obliged to pay maintenance?

You give notice with sufficient notice of a General Meeting at which resolution to form association and register it, will be passed. Send the notice under certificate of posting or by registered AD (latter is better) to all the members at their known address. Those who want to attend and those who are able to attend may come. If you pass resolutions at such a meeting that will be binding on the members who do not attend also. It will be binding on those members notices to whom were not delivered also. Nowadays sending notice by email also may be valid.
