Sir,

Wife left home 6 years ago. She tried for 498 A in 2 cities (3 police stations) in this period. In discussions she proved wrong. She w'draw her applications.

1)She filed DV 2005 case, in which she proved wrong (all her demands rejected in judgement).

2)In crpc 125 she got rs. 1000/- pm for her and rs. 400/- pm for child.

3)My divorce case is on last stage (final arguement).

Now police filed 498 A against us (6 persons).

a)My mother is on last stage of Cancer. sisters are married. Is it possible to exclude them from list of accused?

b)My cousin brother's name included for the first time in these 6 years (He is govt. servant).

I have so many documents to prove our innocence. Is it possible to save my sisters and cousin from harrassment?

File for quashing of FIR in the high court along with all the documentary evidence you have including the certified copies of the .previous judgments etc.

1. Hire a seasoned Criminal Lawyer.
2. Chamber discuss your brief and there is higher chance of Quashing of counterblast / afterthought FIR after a lapse of 6 years with multiple forum hunting history of complaint case.
3. File application for discharge of mother's name.
4. Exemption Application for married Sister and Brother can also be filed.

Hello 

It is possible to save your sisters and cousin from harassment. You can file a quash petition before the jurisdictional High Court under S.482 of Cr.P.C.

Keep all the previous complaint with the help of RTI Act. and file for Quashing.

hai , my wife has filed 498a case on mee ,,, now i got regural bail ,,,, now problem is i run small scale industries ,of 15 to 16 lakhs of business,,, now she is entreing in to the factory premises and shouting at mee and making new sense ,,,,, creating the problem ,,,,  propietior is my self ,,,,,,,, what is the producure to obtain the injuction order ,,,,,,,,,, what is the best way to come out of the factory problem

Raghu,

1. Keep some dog in side your factory whenever she come ask it to welcome her.

or

2. Ask your worker to welocme her.

or

3. You should welcome her so that she will file one more case...
