Withdrawal of provident fund

employee resigned from the company in march'2011, an 1 month prior resignation letter was given to the concerned department and the same granted after fulfilling the company's norms. till now company not helping the employee to submit Form 19 and Form 10C for withdrawing the total amont from his PF a/c, stating that the employee's clearence after resignation is not submitted to the company head office by the concerned depertment in
which the employee employed.

1)what kind of step is needed to withdrawing the PF a/c?

2)what kind of step is needed against this company?

If company is not supporting in your withdrawal. You can directly submit withdrawal form forwarded by bank manager of nationalised bank or post master of post office, or two gazetted officers.

Dear Sir,

It is duty of the employer to help Employees to settle the Provident Fund dues of his employees.
He has to complete the prescribed application within 5 days of receipt & hand over it to the employee when he leaves the service.
When a employee finds difficulty to get the form attested by the employer, he can get the attestation of any of the following officer & send to the Provident Fund office

1. Manager of a bank.

2. By any gazetted officer.

3. Member of the Central Board of Trustees./ committee/ Regional Committee (Employees'
Provident Fund Organization).

4. Magistrate/ Post/ Sub Post Master/ President of Village Panchayat/ Notary Public.

Either make a complaint to concerned RPFC giving details with the request to call for the Claim Forms Through his E.O. Or submit fresh Claim Form duly attested by any of the prescribed authority and send it to the RPFC with the request to get it attestted from the employer if still required. Employer can be prosecuted for not attesting the claim form.
