VERY URGENT

Querist : Anonymous (Querist) 26 November 2009 This query is : Resolved 
RESPECTED SIR,
AS UNFORTUNATELY MY WIFE FILED 498A 406 & 34 IPC,WITH THE HELP OF POLICE OFFICIALS AT WOMEN CELL DELHI,AND NOW SHE HAS FILLED THE DIVORCE AT FAST TRACK COURT.

MY QUERY IS THAT WHAT SHOULD I DO
DO I NEED TO FIGHT 498A FIRST OR DIVORCE CASE
PLEASE GIVE ME SINCERE OPINION.

u have to face both the cases at once, lodging a complaint against u and ur family members u/s. 498-A,406 & 34 of IPCand pendency of the same is a good ground for divorce, which stands in ur favour if u are willing to get divorce if u are not willing, send us the details by mailing me at skondaplly666@gmail.com or call me at 0990 8020 994 for further advise

evenafter receipt of divorce notice ,iif u didnot attend the court on particular day the divorce petition will be heard exparte automatically, if u attended that you will have a chance to submit ur version, and moreover the pendency of divorce case will be an additional advantage and good ground to proceed with 498-a,406 & 34 of I.P.C. and consequently to get acquittal in such case.

Both are seperate proceedings both the cases will have to be contested.

If you want divorce then remain absent from the court exparte decree will be passed.

you are advised hereby first settle criminal cases pending against you and your family.Delay the divorce case till the court will acquit you and your family, or the allegation may be withdrawn by your wife through mutual understanding .
