Society Matter

Querist : Anonymous (Querist) 01 June 2010 This query is : Resolved

Dear Sir,

1)Can an Associate Member of a Co-operative Housing Society become a Secretary of the Society.

2)Maharashtra Co-op. Societies Act, 1960 is governed by ROC or by State Govt?

Thanks.

All State Acts are governed by respective State Governments. Only Indian Companies Act and Limited Liabilities Partnership Acts are governed by ROC.

There is no bar in the Act. But Act says the Registrar may stipulate qualifications and disqualifications. Please check whether such bar is there in Maharashtra.

Certain state acts does not give voting right to associate members. In the absence of voting right, a member cannot content election or become an office bearer of the society.
