Married womans share in ancestral property

(Querist) 21 June 2012 This query is : Resolved
A person died living behind 3 sons and 3 daughters. All the 3 daughters are married since more than 30 years and alive. Whether they can claim their share over the property of their grandfather?

What is the law of sharing if there is any reference please advise.
Sankaranarayanan (Expert) 21 June 2012
yes they have full right to collect their share

Dear Mr.Daga,

Yes they have an equal share alongwith sons. The Succession to a Hindu intestate's(without will) property devolves as per the Hindu Succession Act.

Dear Mr. Narendra,

You have to give complete facts, in case you desire appropriate and usable answer.

Please indicate when did the grand father die? Whether the property was self-acquired by the grand father or he got it from his father?

Please indicate when did the father of the daughters die?

Presently, the property is in whose name?

Where is the property situated?

Rather the family belongs to which State?
Shonee Kapoor (Expert) 21 June 2012
Yes they have same share as that of sons after 2005.

Before 2005 it would depend upon the state and year the succession has opened.

Regards,

Shonee Kapoor

The property in question was ancestral property recorded in fathers name. After the death of the recorded tenant (father) the 3 sons alineated the entire property to me in the year 2002 in Orissa state. Now after a gap of about 10 years of my purchase the 3 daughters are claiming their share in the said property though they have been married since morethan 30 years earlier.

Whether the daughters are entitled to their share? If so what law prevails under succession act as per Orissa state.

Mr. Narendra !

Its better to contact a local advocate with all the relevant papers so that your problem will be solved.

In general manner, I agree with Mr. Shonee Kapoor.

Dear Mr. Nagendra,
Unless you come forward and give the details asked for by me (i.e. giving the exact particulars including years etc.) you will not get appropriate answer. Whatever answer you may get without revealing the complete facts, you will not be really able to make use of such answers. The choice is yours - whether to reveal the complete facts and to get appropriate answer OR to simply beat around the bush and to end up with not getting any worthwhile answer at all.
