Respected Sir,
I am a Cost Accountant working in a construction company as a Sr.Accountant. On 30.04.2010 I submitted my resignation from the said company and requested the company to settle my dues and given them 15 days notice (as per my offer letter).Now my salary from the month of Feb-10 to April-10 is pending (as company not able to give salary to all employee till dated 01.05.2010) Sir, my question is: 1) What are the legal steps I able to take against company if he fails to give my final dues, 2) Company declare bonus (which is given at the time of calculating total earning while calculation for TCS Calculation As my hometown is Delhi and my Head office is in Mumbai
Pls help me in to out come from this problem My current outstanding is more then Rs 50,000/-

First talk with the company management about your pending dues.
If you are not getting any favourable reply, then send a legal notice.

only yesterday you had resigned. wait some more time before thinking of legal remedies.
first talk to the HR/personnel dept of the company. If the reply/response is not good,initially sent a letter to the company by regd post and wait for their reply for some 15 days. then if needed sent a legal notice.

YOU MAY KINDLY SEND A LEGAL NOTICE AND DEMAND SETTLEMENT OF ALL DUES WITHIN TWO WEEKS. IN CASE YOU HAVE ALREADY ISSUED A NOTICE THEN YOU MAY FILE A CIVIL SUIT IN LOCAL CIVIL COURTS AND CLAIM ALL DUES FROM THE COMPANY WITH COST AND COMPENSATION. ALTERNATIVELY YOU MAY FILE A WRIT PETITION IN THE HIGH COURT. KINDLY NOTE THAT AS PER CLAIM AMOUNT YOU HAVE TO PAY COURT FEE STAMS IN THE COURT . KINDLY SEND DETAILS IN CASE ANY FURTHER HELP IS REQUIRED. THANKS.
