Society Registration

I stay in Sanpada Sector-5, navi Mumbai and the building in which we live was a land owned by a agri person who in partnership with the builder constructed this building and the builder gave him the whole first floor for both the wings. Now the land owner is not allowing us to make the society registration and also not the tria party agreement because of which we are uable to sell our rooms...can u please advise what can we do...the owner and the builder had some disputes because of which we r facing problems, plzz need ur helpp..

First of all, you have clarify certain things as follows
1. What are the documents were obtainted by you before purchase of your flat?
2. Whether your flat has been registered in your name along with UDS( Undivided Share)?
3. In what capacity the buildier executed documents whether as owner or power of attorney?
If the flat have been sold in favour of flat owners along with UDS, then all the flat owners can create and register a society. In future, if altereration or any other construction or developmental to be required the society can file suit unde specif relief act as easmentary right against the owner of first floor.

MOFA act is getting ammendment in few days it will be mandetory for builder to register UDS . if he is not keen in it there provision for deemed UDS.
