passing a will

sir,
how to pass a will?? is any specific statuotory procedure? when is the only hand written will signed by the deceased is valid an on wat grounds? can it be challenged?

will can be challenged at any time. there are so many ground to challenge it , depends on the circumstance.

Will can be executed by any person in the presence of at least two witnesses. He may get it registered or not and in both the eventualities, the will shall be valid. However, it is better to get a will registered because in case of challenge, a registered will comparatively get more weightage due to presumption attached to the endorsement of the Sub-Registrar.

A hand-written will is equally enforceable as a typed or computer-typed will.

Wills of all kinds may be challenged and the person in whose favour the will was executed will have to prove it by producing at least one of the attesting witnesses to the will.
