(Querist) 24 November 2018 This query is : Resolved
Sir,
Is there any time limit for filing application under section 156(3) CRPC ??
I know there is a time limitation for cognizance but, I am confused over 156(3).
Regards.

The answer lies in your question itself. You are aware that there is a time limit for cognizance of certain offences. If the complaint itself is time barred , then question of filing an application under 156(3) for ordering investigation of such offence does not arise.
I do not appreciate your remark "Baj gayi band???? No reply".

Time limitation of congnizance will apply to private compliant u/s. 156(3).

But, if police has caused the delay, then, what bars judiciary to order an investigation??
Cognizance is a later stage. Delay by police is itself explaination for delay.
What do you say Sir ??

In case of delay by the police, question will arise what prevented the applicant to approach the court well in time for directions to the Police under the Section. If the court is satisfied that there are sufficient reasons for the applicant not approaching the court before expiry of the time, the court may entertain the application.
@Rishab. You should know that the experts are not glued to this forum at all times 24 hrs to answer your supplementary. Have some patience.
