Rights of a Respondent

Querist : Anonymous (Querist) 27 February 2010 This query is : Resolved
I am a respondent in a motor vehicle accident case. This is a case for compension under section140/163/A I have appointed an advocate but is too raw. I wish to cross examine the doctor myself. Will the court allow me to do this? with my advocate standing by my side? If yes
under what legal provision I can do it? I mean if the judge refuses for this what legal points I have to cite in support of my right to cross examine.
Alternatively can I stand along with my advocate during the cross & openly prompt him as to the questions to be asked?

Yes. You can cross-examine the witness of the petitioner even in the presence of your counsel. A Judge cannot refuse to permit you to cross-examine as it is you who are accused and the advocate has been engaged by you just for assistance.

You can also assist your counsel while he cross-examines a witness.
