To occupy flat in maharashtra cooperative soc with nominatio

My question is can any nominee occupy or stay in flat who is legal heir but main nominee is not appointed in case of family disputes

A family member of the owner can reside in his flat during his lifetime and also after his demise. Nomination is to permit the Society to transfer the share certificate of the flat to the name of the nominee, it does not bequeath ownership rights on the nominee. The legal heirs of the owner of the flat can always get the possession of the flat from the Court.
