Adoption of step-daughter by non-indian step-mother

I'm an Indian citizen (hindu by birth) living abroad (NRI for last 2 years) My daughter is four years old... my first wife (biological mother) passed away due to complications in child birth. Two years ago I married a foreign national. How can my wife (who is not Indian or Hindu) legally adopt our daughter? We would also prefer to change the mother's name on daughter's passport. Thank you for your advice.

PS: I have already asked this in the main forum as I did not know about the "Experts" section!

As you are the biological father of your daughter and getting married to a foreign national after the death of your first wife. Then why you want your second wife to adopt your daughter? Is it only for the sake of the name in the passport?

Your wife is a foreign national so Indian law regarding adoption does not apply to her. Ask any advocate of the country where you are residing

First of all thank you for taking time to help out, really appreciate it.

The primary reason for us wanting my wife to legally adopt is ease of travel / VISA. Secondary is that it would enable our daughter to get admission in the school of our choice. Not being a legal parent of my daughter my wife can not sponsor her VISA... the school seats are also given priority by type of VISA / resident permit.

The name change on passport is not a must do. We would "prefer" to change the name on passport, just to not put our daughter under stress, if avoidable. She believes her step-mother is her real mother... we want to tell her when she is old enough to understand.

If one of the prospective adoptive parents is foreigner and other is an Indian, such case shall be treated at par with Indians living in India.
