(Querist) 27 July 2012 This query is : Resolved
Dear Sir,

My bachelor brother died inestate. One Brother and sister predeceased and 1 brother and 2 sisters post deceased.

Want advice whether children of the post deceased will be entitled for property share.

If yes some children are not in contact and we are unaware of their wherebouts so how should we proceed in the said matter.

Whether can we indemnitise on their behalf in the court so that there is no hindrance in selling the property.

Thanks and regards,
P. Gangwani.

Children of the deceased are entittled for the equal share in the share of the deceased. You cannot avoid them. Even if you submit before the court that you dont know the whereabouts of the children of the deceased, court wont permit you to sell the property.

Dear Sir,

So what is the solution to this problem? Can we put it in the newspaper and wait for someone to come forward.

Secondly what is the waiting period?

IF not then what is the alternative to this.

Thanks and Regards,
P. Gangwani.
