(Querist) 18 June 2012 This query is : Resolved
purchased a flat in 2009 through registered sale deeds,Have complete original Chain Of Document(Sale Deeds). The said property has been sold to five different persons through registered sale deeds before one purched it in 2009.Now one of the past owner of this property who sold it through registerd sale deed in 1993 filed complaint with police stating that one of my relative has sold this property by forging my signature.Police is insisting us to provide original chain of documents to verify the thumb impression and signature of complainant though photo copy of all the Sale Deeds given to the police. Please advise the remedy available for not to submit original sale deeds and in case complaint is found correct how we can safegaurd our interest in the said property as we are a bonafide purchaser. Can any one file the above complaint even after 18 years.is law of limitation is not applicable in such type of case.

The law of limitation does not come to the rescue in such type of cheating cases. That person may not be aware of the fact till today. Of course he will have to prove everything in the court.
Everything depends upon the facts and circumstances of each case. However, you can safeguard your interest. The person will have to prove forgery and and how he was cheated before the civil court to get declared all the sales void. Everything depends upon the fact and circumstances so, consult a good local lawyer who can handle such cases properly.

Archana ji,Thanks for your immediate reply. My immediate concern is how i can avoid submission of original Sale Deeds to police because i have fear that once it is submitted it will be difficult to get back the same till the case is settled by the court.Though i have already submitted the photo copies of the Deeds and have also requested to police to verify the signature and thumb impression of seller from the office of Sub Registar where original signature and thumb impression are available. But police is pressurising me to submit original sale deed.Could you suggest some remedies for the same. Regards

You can ask him to obtain court order for surrender of the sale deed.
