New rental law w.e.f 2011

I am a tenant since 1976 in a commercial shop located at a prime location in Pune.
my landlord died 20 years ago and since then his son has not been accepting rent nor giving the rent receipts,I however have all the proofs that I had been sending him rents all these years through money order rpad and that he didnt accept it.
he has filed a case against me for eviction in the court,stating I am a defaulter in payment of rent.
I am ready to pay him for ownership as per market rates,he doesnt seem interested and says dont talk about the property.I have been conducting the same business all these years and the rent receipt is in my firms name.
my query is,can I start another business in my firms name without the landlord consent and without any legal hassle,like I said he doesnt even talk and starts abusing.
once the 2011 rent law gets passed I'll have to staart paying rent as per market rates which is not possible in my current business.

You are an old tenant so no market rates but on ground of default of rent you can be evicted.

Engage a good advocate dealing in such matters and apply immediately for fixation of standard rent and for that produce whatever available records of rent which was being paid.

And than immediately deposit in the court all due rents.

If you can do both than under current Mah rent control act- no eviction and no raise in rents. And you can do any business you like.

Agree with JSDN

issue him Notice, sending the amt of Rent by Cheque.

File Suit, that he try to evict me, a old tenant, demanding higher rent, and not accepting the rent offered, and let Court fix std rent, & Deposit Rent with permission of the Court, in Court.
