Documents are not returned by bank even after koan is disbursed

Sir, I was a guaranter to rhe loan.the loan is settled in "one time settlement".The whole amount is deposited on 30/03/2011.But yet bank has not returned the following documents: 1. Loan clearence certificate. 2.NOC for "mortgaged properties & auctioned property"\ 3.the blank cheque deposited against the amount to be disbursed. Sir plz guide me can I file criminal suit against the bank authorities for upholding the documents even when loan amount is disbursed & can I claim compensation for my mental & financial harassment.

Please indicate whether you wrote any letter to the Bank asking for these documents? If so, when did you write? Have you got acknowledgement from the bank on the copy of those letter(s)?

In one time settlement the loan has to be cleared by the divisional office. So the branch has to forward the papers and get approval and clearance. Apart from you have to speed up the process by contacting the branch in written. If they fails then only you have to approach the proper forum(i.e Banking ambudsman). Also you can send the legal notice claiming the documents.

agree with mr ganesan first you contect the branch and if they cant give you proper information or satisfy answer then u send legal notice and complain against bank in consumer forum in my sence you will not sucess in criminal case

I HAVE POSTED A REGISTERED LETTER ASKING FOR THE DOCUMENTS AND HAVE RECEIVD THE ACKNOWLEDGEMENTS.BUT HAVE NOT RECEIVED ANY RESPONSE.WHERE TO FILE THE PETITION AND HOW TO CLAIM THE COMPENSATION.

Dear Mr. Anonymous,
If you are interested only in claiming the compensation, jolly well go ahead and file your case.
But, you are not realising the minimum requirements. That is the pity.
You should realise that you are only a guarantor. I doubt very much whether the certificate, if any, like 1. Loan clearence certificate. 2.NOC for "mortgaged properties & auctioned property" 3.the blank cheque deposited against the amount to be disbursed, etc., would be returned to the guarantor. My understanding is that the same would be returned only to the original borrower and not to you.
In any case, you are not ready to state as to when did you send the letter. Whether sufficient time has lapsed for the bank to act or react? Did you follow up your request or just because you sent a letter and there is no response from the bank, you want to jump the gun and want to file a case. Without giving these details, you are harping on filing a case. Ok, please yourself, go ahead and file the case.

i agree with mr Ramachandran that the bank will return all these documents to the original borrower of loan and not to the guarantor
