Querist : Anonymous (Querist) 21 April 2011 This query is : Resolved 
complainant purchased a flat in sale consideration of 21 lack . the above amount 7 lack received cash and after that 14 lack received through cheque . and sale deed registered sale deed amount rs 14 lack .
my specific query that
*the builder received cash amount 7 lack is not mentioned any where is legal?
*as per the commitment of the builder "flat complete in all aspects with modular kitchen" wordings what are the cover these words in flat
*any remedy in Indian law for the recovery of the amount which were not shown in sale deed
*is it cover under the UN fair tread practice

Why did you pay the huge amount of Rs. 7 lakhs in Cash? Did you get any receipt for the said payment? When only the amount of Rs. 14 lakh was mentioned in the Sale Deed as consideration, why did you not object and why did you not insist that you paid Rs. 21 lakhs and that should be mentioned in the Sale Deed as well?
Only after knowing the above answers, it will be possible to give a view to your query.

I Agree with Mr Ramchandran ! Is the Registration Office basic value is only 14 Lakhs -if so to avoid the Stamp duty the Sale deed is show as 14- Lakhs only , for the remaining finishing works you have paid the 7 lakhs - if so get an agreement from the Builder with that 7 lakhs he will complete the Kitchen , Word robes etc

Sir ,
at the time of giving cash taken received . but original receipts at the time of sale deed registration demanded and i have returned and i have only photo copy of receipts.

and i m objected at the time of cash trangection but builder declined my request because he is not shown in his accounts.

dear most of the builders are cheating people and people are ready to be cheated.


people often sign agreements and make transactions without knowing the implications.

you might be having a very good case but the fact is whether you will be able to prove your claim?

In the absence of original receipt for cash payment your case can become weak. However, that depends upon the discretion of the cosumer forum to recognize or not the photocopy of the receipt, if you decide to file any case against the builder.

You dont have any documents to prove your claim. Dont waste the time. You got the property in your hand for the value paid . Be happy.

Many builders collect money, not handing over the property in time (late by few years).

you said Rs.7 lakhs was paid by cash. Now you say you have bank records. How is it possible?

7 lack ammount received cash through self cheque and given to builder .and taken receipt

attested photocopy by noteri public tru copy attested
