Hi All,


Wife alleging husband was not able to remember what food he ate, did not even know who was accompanying him, did not know route to his residence and was sitting aloof and was afriad of darkness.

What does these allegation convey to a judicial mind. Does this convey allegations of mental disorder or allegations of (psychological) impotency.

can the above allegation be linked to impotency of any kind.

First of all your question is not clear whether you are the husband or the wife, or even belong to the judiciary, as you are asking on judiciary point of view? Secondly, Whether you are asking for the solution from the point of view of the plaintiff or the defendant?

About the problem, forgetfulness cannot be treated as mental disorder. This problem can be on account of the disease known as Alzheimer, which is curable.

The fear of darkness, which is also a disease known as nyctophobia, is a psychologically-impacted feeling of being disposed from comfort to a fear-evoking state. The concerned person may be having some fear of some unexpected harm from some person from his nears and dears even. He or she may also be afraid of his or her spouse.

In fact, such persons need special care from his nears and dears and not to be sued in a court of law.

However, it would have been better had you consulted some medical specialist instead of legal experts about such disease.

Dear Mr. Dhingra,

Thanks for your reply and I really appreciate your expert views. People who are going thro litigation instituted purely out of malafide intensions to harass the opposite party are already put under fear phychosis which can only be cured by the healing touch of the judiciary.

After seeing your response it can only be concluded the allegatons are recklessly made.
