second marriage without notifying the other party

Guest (Querist) 25 March 2011 This query is : Resolved
My question is if a person is mutually divorced under the court of law and does a second marriage after 8 months of receiving the divorce papers and the other party is unaware of the 1st marriage then under this circumstances:

(1) is the 2nd marriage valid?

(2) is any investigation done during the 1 month prior notice to marriage which will reveal that there was a 1st marriage/ is there any chance that the marriage registrar investigates about 1st marriage due to which he may not allow the 2nd marriage?

If a person is properly divorced (whether on mutual consent or otherwise) there is no bar for him to get married again.
The subsequent marriage after divorce, is valid.

thank you for your reply but i also wanted to know that if the other person isnot aware of the 1st marriage then is there any chance that the marriage registrar does any investigation during the 1 month notice period before marriage and finds that that if there was any 1st marriage, which the party has been hiding ? is there any change that the 1st marriage gets revealed during the notice period?

It is not the job of registrar to investigate, his office gives public notice and interested parties may object.

Dear Mr. Jitender,

In the instant case, how can there be any aggrieved party in the second marriage? Non-disclosure of first marriage may be a grouse for the lady who is marrying the person, but on that basis can the marriage be made null and void? Please elaborate what do you mean by declaring the marriage null and void in the given facts and situation.
