kind sir,

your reply has given me some courage but

forwarding to my last query

if sufficient proofs are present that my father had given more than 50% payment of the said flat then in such situation can court give the power in the hands of my father.

provided said cheques through DD and payment transfer from my father's account.

few times money transfer account to account for the same.

kindly guide me

See section 53-A of Transfer of Property Act. It depends upon conditions laid down beteen seller and buyer in respect of said property..

You may please better like to see the language of the agreement between the seller and buyer of the property. That can best guide you about possession of property. Court of law would not allow dishonor of the agreement by any party, unless proved invalid.
