The Indian Evidence Act, 1872 is procedural law and mereby prescribes procedure. The provisions of the Indian Penal Code, 1860 are substantive and define offences and provide punishment. The offence can be said to have been committed under the provisions of the IPC stated in the query and not under the provisions of the Evidence Act.
