Fake Ownership & Rent Agreemnt......

Querist : Anonymous (Querist) 26 February 2011 This query is : Resolved 
If a close relative of mine, rents out my self owned property to someone else,claiming himself to be the owner. Signing a legal Rent Agreement with that person,taking cash each month as rent.

But unfortunately a year later my relative expires and now the so called illegal tenant refuses to vacate the place before the end of the agreement,2yrs from now.

What all can I do now to recover my property back to me?

One who collects the rent is Landlord. The owner is also landlord because the rent is being collected on his behalf.Issue a notice to the tenant to pay rent to you. If he pays rent to you then you can not ask for eviction before expiry of two years, the agreed period. If he does not pay rent then file a suit for eviction.
