Still any maintenance applicable?

Dear All,

One of our Client(husband) got ex-parte for maintenance suit.

In the maintenance suit wife claimed interim maintenance and maintenance till divorce, mean while divorce suit also got ex-parte.

But still husband is willing to reunion, no 498a on husband.

As it is a love & arranged marriage, husband till date is writing/wishing(greeting) his wife for festival, birthaday, marriage anniversary and other seasonal greetings.

RCR was also filed, adjournamnets are going on


Note:However the parents, family members, relatives and some neighbours of the wife, constantly interfered and attempted to poison their marital relations by carrying tales, to the wife against husband.

Since husband's family is a joint family and the entire family is managed by husband's mother this created more mis-communications, misunderstandings by the mother of wife(husbands aunty).

This is the actual at play due to constant back-biting by these evil elements against wife about her individuality.

In such a vitiated atmosphere, wife fell prey to their machinations and became a tool in their manipulative hands.


My question:
Still husband has to pay interim-maintenance and other charges till the time of ex-parte decrees (maintenacne and divorce) as husband really want to reunion.

if the divorce petition is still pending he is liable to pay maintenance pendelite. In case he wishes to reunite then he has to take back the divorce case.
