Time limit for filing a counter for a Rejoinder

(Querist) 21 February 2011 This query is : Resolved 
In a civil suit the Plaintiff files Rejoinder immediately after a government department files a Written Statement.

Now that Government department is not filing counter, it has been more than 120 days since the plaintiff has filed Rejoinder.

In this case what is the time limit for filing Rejoinder ?

There is no provision in the Code of Civil Procedure, 1908 for filing of re-joinder by the defendant. Make a request to the court to frame issues and fix the suit for evidence.
