dear sir,
i am facing a peculiar problem. in one of the documents pertaining to a family asset another person has claimed his right and produced a xerox copy on which my father's signatures are there. we also have a xerox only and lost the original. if my father denies putting his signatures my question is that :
(a) can a handwriting expert or forensics expert give his opinion based on a xerox copy. How reliable is it and will it be admissible in court.
(b) who has the burden of proof if both parties have only xerox copies
(c) can court pass a judgement based on a xerox copy only and in the absence of any other proof when both parties are filing counterclaims
(d) in case the judgement goes against us what remedy or recourse can we claim. thanks
