It was a clear bolt from the blue for mobile companies when the Rajasthan high court ordered the telephone firms not to install mobile towers in residential areas of Jaipur.

Responding to a writ petition on Monday, a single bench of high court comprising Justice Gopal Krishna Vyas stayed the installation of cell phone towers in residential areas of Jaipur city. The court also ordered that no permission for installation of mobile towers in Jaipur city would be given without prior authorisation of the court.

Divulging details of the case, counsel for the petitioner, PK Sharma, told DNA, "On behalf of one Vimla Sharma, a resident of Durgapura, we have filed a petition requesting the court to stay the installation of mobile towers in residential colonies. Citing the ill-effects of mobile towers we have also informed the court that the rays from mobile towers may cause cancer and other skin-related ailments."

Sharma added, "If mobile tower is installed within the 350-metre area of a residential colony, diseases like cancer, skin ailments and brain-related problems may affect people. Thus, these towers should be installed far away from residential colonies."

The court has not only given relief to the petitioner but has also said that no mobile companies can install towers in residential colonies. The court has also issued notices to the state government through chief secretary, department of urban and housing development through its secretary, Rajasthan state pollution control board, district collector, Jaipur; Nagar Nigam, Jaipur and one resident of Durgapura.

Meanwhile, the state government is also chalking out a policy to crack a whip on cellphone towers in the residential areas in the city. Under the new policy the mobile companies will have to pay the registration and monthly charges to local bodies in the area where the towers are installed. The cost of registration would be around Rs1 lakh and the companies will have to pay Rs5,000 monthly rental...............LAWYERS AT CITATION
